Elemyntz is committed to maintaining a safe and trusted digital environment. We enforce a zero-tolerance policy toward any form of child sexual abuse and exploitation (CSAE), including the creation, distribution, possession, or facilitation of child sexual abuse material (CSAM), grooming, or any behavior that endangers or exploits minors.
All CSAE-related incidents are treated as serious violations of Elemyntz’s Terms of Service and are subject to immediate removal, user termination, and reporting to relevant law enforcement and child protection authorities.
2. Legal Compliance
Elemyntz complies with all applicable local, national, and international child protection laws, including but not limited to:
- The PROTECT Act of 2003 (U.S.)
- The Children’s Online Privacy Protection Act (COPPA)
- The EARN IT Act (U.S.)
- The UK Online Safety Act
- The EU Digital Services Act (DSA)
- The UN Convention on the Rights of the Child
Elemyntz cooperates fully with law enforcement, regulatory authorities, and trusted child safety organizations such as the National Center for Missing & Exploited Children (NCMEC), Thorn, and INHOPE.
3. Definitions
For purposes of this Policy:
- Child Sexual Abuse Material (CSAM): Any visual depiction of a minor engaged in sexually explicit conduct, as defined under applicable law.
- Child Exploitation: Any activity involving coercion, grooming, trafficking, or the sexualization of minors for monetary gain, gratification, or other benefit.
- Grooming: The act of building emotional connections with minors for the purpose of sexual exploitation or abuse.
- Minor: Any person under the age of eighteen (18) years.
4. Detection and Moderation
Elemyntz employs a multi-layered approach to detect and prevent CSAE-related content and activity:
- Automated Detection: All images, videos, and other user-uploaded media are scanned using AI-based CSAE detection systems and industry-standard hash-matching databases (e.g., PhotoDNA, NCMEC hash sets).
- Behavioral Monitoring: Communication patterns indicative of grooming or exploitation are flagged for review using machine learning systems.
- Human Moderation: A specialized Trust & Safety team reviews flagged content to confirm violations and escalate cases for immediate action.
- Immediate Action: Verified CSAE content or behavior results in permanent account suspension, content removal, and mandatory reporting to NCMEC and appropriate law enforcement agencies.
5. Reporting Mechanisms
Elemyntz provides accessible and confidential reporting tools to ensure that users can report CSAE-related concerns efficiently:
- In-App Reporting: Available on all profiles, posts, and messages.
- Emergency Escalation: Serious incidents are reviewed within 24 hours of submission.
- Law Enforcement Referral: Confirmed CSAE cases are reported to NCMEC’s CyberTipline and relevant local authorities.
- Victim Support: Elemyntz provides victims or affected users with access to confidential support resources, including helplines and counseling services.
6. Data Handling and Evidence Preservation
When CSAE-related material is identified:
- Elemyntz immediately removes the content from public access.
- A secure, encrypted copy is retained solely for reporting and law enforcement cooperation.
- Data handling follows strict chain-of-custody and evidence preservation protocols.
- No CSAE-related data is used for any AI training or analytics purposes.
7. Employee Responsibilities and Training
- All Elemyntz employees, moderators, and third-party contractors undergo mandatory annual CSAE awareness and response training.
- Employees must immediately report any suspected CSAE material or behavior to the Trust & Safety team.
- Failure to comply with reporting obligations may result in termination and potential legal liability.
8. Privacy and Child Protection Measures
- Elemyntz implements age verification systems to identify and protect underage users.
- Restricted functionality applies to accounts verified as belonging to minors.
- Adults are strictly prohibited from deceptive or inappropriate communication with minors.
- Parents and guardians are provided with educational materials and resources to monitor and guide minors’ online safety.
9. Transparency and Accountability
Elemyntz maintains a culture of transparency and publishes a Trust & Safety Transparency Report annually. This report includes:
- Number of CSAE-related reports received and resolved.
- Law enforcement referrals made.
- Improvements in detection technologies and moderation practices.
- Updates to internal child safety protocols.
